Avina Americas is a Delaware non-stock, non-profit corporation described in Section 501(c)(3) of the U.S. Internal Revenue Code and received a determination letter in 2009 from the U. S. Internal Revenue Service confirming its status as a public charity under Section 170(b)(1)(A)(vi).

Avina Americas is an independent legal entity that conducts activities in coordination with Fundación Avina and the other entities in the Avina ecosystem and provides support for programs conducted by Avina entities outside the United States that further the charitable mission of Avina Americas. The Board of Trustees of Avina Americas evaluates foreign activities for support and may seek grants and contributions within the United States to support such programs.

As a U.S.-based 501(c)(3) organization, Avina Americas files an Internal Revenue Service form 990 on an annual basis.
